01Scope and provider

The provider and seller is Rümeysa Biricik, FarbenWellen, Kapitän-Lehmann-Ring 28, 28309 Bremen, Deutschland ("we"). These terms apply in the version valid at the time of your order.

Our works are handmade one-of-a-kind pieces; variations in colour and structure are inherent to the art and do not constitute a defect.

02Conclusion of contract

The presentation of products in the shop does not constitute a legally binding offer but a non-binding invitation to order. By clicking the order button you submit a binding offer.

Receipt of your order is confirmed automatically without delay; this confirmation does not yet constitute acceptance. The contract is concluded when we declare acceptance or dispatch the goods.

03Prices

All prices are final prices. As a small business within the meaning of § 19 UStG, we do not show value-added tax. Shipping costs are included in the stated price (free shipping); the applicable price depends on the delivery country.

04Payment

Payment is processed via the payment provider Stripe (credit/debit card and other payment methods offered by Stripe). The purchase price is due immediately upon conclusion of the contract. You enter your payment details exclusively on Stripe's secure payment page.

05Delivery and shipping

We deliver within Germany, to the EU and to selected other countries (including non-EU European countries, the USA and Canada). Unless otherwise stated, delivery within Germany usually takes 3–7 business days; longer for international deliveries.

For deliveries to countries outside the EU, customs duties, import VAT or other charges may apply; these are to be borne by you as the recipient and are not included in the price.

06Retention of title

The goods remain our property until full payment has been made.

07Right of withdrawal

As a consumer you have a statutory right of withdrawal. Details are set out in our withdrawal policy available at www.farbenwellen.de/en/widerruf, where an online withdrawal function is also provided.

08Warranty / liability for defects

The statutory law on defects (§§ 434 ff. BGB) applies. In the event of justified defects, your statutory rights apply without restriction.

09Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For simple negligence we are liable only for the breach of a material contractual obligation (cardinal obligation) whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely; in that case liability is limited to the foreseeable damage typical for the contract.

Otherwise liability is excluded. Liability under the Product Liability Act remains unaffected.

10Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

11Applicable law and final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of their country of habitual residence.

Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
